We communicate with the Customer in the language of the website on which the order was placed, or in Polish or English.
§2. Definitions
Customer — a natural person, legal person or organisational unit placing an order.
Consumer — a natural person making a purchase for purposes not directly related to their business or professional activity.
Trader with consumer rights — a natural person conducting a business for whom the contract is not of a professional nature (as follows from the subject of their business registered in CEIDG); such a person has the Consumer rights described in §7–§8.
Personalised product — a print made from the Customer’s file and a product made in a size or version to individual order.
Contract — a distance sales contract concluded through the Shop.
§3. Technical requirements
Using the Shop requires a device with internet access, an up-to-date browser with JavaScript enabled and an active e-mail address.
The Customer is prohibited from providing content of an unlawful nature.
§4. Products and prices
Prices are shown in the selected currency. For Consumers, these are gross prices including the VAT applicable in the country of delivery (for sales to consumers in other EU countries we apply the VAT rate of the country of delivery under the OSS scheme). When the “business prices” view is enabled, we show net prices.
Businesses from another EU country with a valid EU VAT number confirmed in the VIES system purchase at the 0% rate (intra-Community supply of goods, reverse charge). For shipments outside the EU we apply the 0% rate (export); customs duties, import taxes and clearance fees in the recipient’s country are paid by the recipient. To Consumers in the United Kingdom we ship orders with a goods value above GBP 135 (VAT and import charges are collected by the carrier from the recipient); smaller orders to the United Kingdom are accepted from businesses with a UK VAT number. To Norway we ship as an export — Norwegian VAT and import charges are collected by the carrier from the recipient.
The delivery cost is shown before the order is placed and depends on the country, the carrier and the size of the parcel.
LEDMESEE frames are manufactured in Poland. Photographs are for illustrative purposes only; the colour of the print may differ slightly from that displayed on the screen.
Standing promotions: a quantity discount on frames (from 2 units), 1 free backlit print with every frame and free delivery above the product value threshold shown in the cart. The quantity discount and the free print cannot be combined — we automatically apply whichever option is more favourable to the Customer. A company account discount (agency, intermediary or customer group) cannot be combined with other promotions: the quantity discount, the free print or discount codes — the only exception is the START BOX offer at its promotional price. A discount code applies on the terms stated when it is made available; one code may be used per order.
§5. Order and conclusion of the Contract
The Customer selects products, provides delivery and contact details, chooses the delivery and payment method, accepts the Terms and Conditions and clicks the payment button.
Clicking the payment button constitutes placing an order with an obligation to pay.
The Contract is concluded when the Customer is sent an e-mail confirming acceptance of the paid order. The e-mail contains the content of the order, and the Terms and Conditions are available at a permanent address in the Shop.
If an ordered product becomes unavailable, we will inform the Customer and propose a delivery date or refund the entire amount paid within 14 days.
Up to 99 units of a given product may be purchased in a single order. Larger quantities and non-standard sizes are quoted individually: office@ledmesee.com.
§6. Payment, invoice, fulfilment and delivery
Payments are handled by Stripe Payments Europe Ltd. (Ireland): payment cards, Apple Pay, Google Pay, BLIK, Przelewy24 and other methods shown when ordering. Payment is made in advance.
We issue an invoice for every order and send it by e-mail as a PDF. The Customer agrees to receive invoices in electronic form. Invoices for businesses from Poland are submitted to the National e-Invoice System (Krajowy System e-Faktur, KSeF).
Frames without a print and accessories from orders paid by 11:00 on business days are shipped the same day; all others — on the next business day. Orders with a print are fulfilled within 3–7 business days of receipt of a correct print file. Non-standard products — within a period agreed individually.
The carrier’s delivery time is stated when choosing the delivery method; details can be found in the “Shipping and payment” section.
The risk of loss of or damage to the product passes to the Consumer only when the product is received by the Consumer or by a third party indicated by the Consumer other than the carrier.
§7. Print files
The Customer provides the print file as a download link (e.g. WeTransfer, Google Drive, Dropbox) — in the order form or in a reply to the confirmation e-mail. We do not accept files uploaded directly on the website.
Recommended file: PDF or JPG/TIFF at 1:1 scale, 150–300 dpi, CMYK, with 3 mm bleed. If the file is not suitable for printing, we will contact the Customer before printing; the fulfilment period runs from receipt of a correct file.
The Customer declares that they hold the rights to the graphics, marks and images contained in the file and that printing them does not infringe the rights of third parties or the law. The Seller may refuse to print unlawful content — in that case we refund the price of the print.
We store files and links solely for the purpose of fulfilling the order and handling any complaint, for no longer than 12 months.
§8. Right of withdrawal from the Contract
A Consumer (and a trader with consumer rights) may withdraw from the Contract without giving any reason within 14 days of receiving the product. For frames and accessories without personalisation, we voluntarily extend this period to 30 days.
It is sufficient to send a statement before the period expires, e.g. by e-mail to office@ledmesee.com or by post. The model withdrawal form in the “Returns and complaints” section may be used.
The right of withdrawal does not apply to personalised products — prints made from the Customer’s file and products made in a size or version to individual order (Article 38(1)(3) of the Consumer Rights Act (ustawa o prawach konsumenta)). We provide this information before the order is placed.
The product must be sent back to the address given in §1(2) no later than 14 days after withdrawal. The direct cost of returning the product is borne by the Consumer. The product should be well protected — preferably in its original packaging.
We will reimburse all payments, including the cost of the cheapest delivery offered to the Customer, within 14 days of receiving the statement, using the same means of payment. A surcharge for a delivery method more expensive than the cheapest one offered, chosen by the Consumer, is not refundable (Article 32(3) of the Consumer Rights Act). We may withhold the reimbursement until we have received the product or proof that it has been sent back.
The Consumer is liable for any diminished value of the product resulting from handling it other than what is necessary to establish its nature, characteristics and functioning.
§9. Complaints (lack of conformity of goods with the contract)
The Seller is liable to the Consumer for the conformity of the product with the Contract under the Consumer Rights Act — for any lack of conformity which becomes apparent within 2 years of delivery.
A complaint may be submitted by e-mail or by post, stating the order number, a description of the problem and — if possible — photographs. We respond within 14 days.
The Consumer may demand repair or replacement and, in the cases provided for by law, a price reduction or termination of the Contract. The costs of returning a product found not to be in conformity with the Contract are borne by the Seller.
Transport damage: please check the parcel on receipt and — if it is damaged — draw up a damage report with the courier and take photographs. This helps to resolve the matter quickly, but is not a condition for the complaint being accepted.
In relation to Customers who are neither Consumers nor traders with consumer rights, liability under the statutory warranty (rękojmia) is excluded and the Seller’s liability is limited to the price of the ordered product; this does not apply to damage caused intentionally.
§10. Out-of-court dispute resolution
The Consumer may seek assistance from a municipal or district consumer ombudsman (miejski lub powiatowy rzecznik konsumentów), consumer organisations or a permanent amicable consumer court at the Voivodeship Inspectorate of Trade Inspection (Wojewódzki Inspektorat Inspekcji Handlowej). Information: polubowne.uokik.gov.pl.
Consumers from other EU countries may contact the European Consumer Centre in their country.
§11. Personal data
The controller of personal data is the Seller. The rules for processing data and cookies are described in the “Privacy policy”.
§12. Final provisions
Contracts are concluded in Polish or in the language of the Shop website. Translations of the Terms and Conditions are for information purposes only; in the event of any discrepancy, the Polish version prevails.
Contracts are governed by Polish law. The choice of law does not deprive the Consumer of the protection afforded by the mandatory provisions of the law of the country in which the Consumer has their habitual residence.
Amendments to the Terms and Conditions do not apply to orders placed before they enter into force.
